What the FCC asked the court to do

The FCC’s September 3 motion asks the U.S. District Court for the District of Columbia to dismiss ABC’s complaint. The agency argues first that Congress channels review of agency orders to federal appeals courts, leaving this trial court without subject-matter jurisdiction. It also argues that ABC has not shown that hostility to its programming caused the early renewal proceedings. These are litigation positions, not findings. Judge Loren AliKhan has not accepted either argument, no licence has been revoked, and the available report says the eight stations may continue operating while the agency process and any judicial review proceed.

Why ABC calls the reviews retaliation

The normal renewal dates for the eight owned-and-operated stations fell between 2028 and 2031, but the FCC ordered early applications in April 2026. ABC says the commission is using licence review to punish the content of its programming and therefore burden speech protected by the First Amendment. The FCC rejects that account. It says the accelerated review arose from an inquiry into alleged unlawful discrimination in Disney and ABC employment practices and from what it characterizes as deficient responses to information requests. The court must evaluate jurisdiction and the parties’ evidence; the timing alone does not prove retaliation, and the agency’s explanation alone does not defeat the claim.

What changes for viewers now

For viewers, there is no immediate loss of an ABC station or program. The concrete change is that the dispute has moved to a procedural test that could end this lawsuit before the court reaches the constitutional merits. If dismissal is denied, ABC may gain a forum to press its argument that the renewal process was weaponized; if granted, the decision may still leave other review routes without validating the FCC’s factual account. The hearing scheduled for the week of October 5 is therefore the next useful milestone. Until then, claims that the licences were pulled, that retaliation was proven or that ABC won are all premature.
