FCC chair Brendan Carr said on Fox News’ Sunday Briefing on September 6 that the agency was looking at multiple actions after President Donald Trump criticized Welker’s account of his primary-endorsement record and called for FCC punishment. Carr said the commission might issue guidance about broadcasters’ obligations concerning what he called fake polls, especially polls he characterized as voter suppression. NBC News stood by Welker. No formal complaint, investigation, rule, guidance or penalty was announced.

In a September 3 motion, the FCC argued that the court lacks subject-matter jurisdiction and that ABC has not shown the causal link required for its First Amendment retaliation claim. This is a dismissal request, not a ruling, and the stations may keep operating during review. A hearing is set for the week of October 5.
